The jurisdiction of this Court has been invoked under Article 226/227 of the Constitution of India for the issuance of a writ in the nature of Mandamus directing the respondent department to release the benefit of family pension in favour of the petitioner on account of death of her husband on dated 10.04.2014 who died during service, in compliance of provision mentioned Rule 5 (2) of the Haryana Compassionate Assistance to the Deceased Government Employee Rules, 2006 as well as keeping in view of the facts mentioned in the present writ petition, in the interest of justice.

Learned counsel for the petitioner submits that he will be satisfied in case a direction be issued to the respondent/State to decide the representation dated 02.02.2026 (Annexure P-7).

Mr. Rahul Dev Singh, Addl. AG Haryana, having served with an advance copy of the petition, has put in appearance on behalf of respondent/State and assures the Court that the above-said representation will be decided within time bound manner.

Without commenting upon the merits of the case, respondent No. 2 - Director Elementary Education, Haryana, is directed to decide the representation dated 02.02.2026 (Annexure P-7) after providing opportunity of hearing to the petitioner and by passing a speaking order within a period of eight weeks from today, and a copy of the said speaking order shall be supplied to the petitioner within one week thereafter.
