On 29.07.2024 the following order was passed : 'On 25.07.2024 the following order was passed : 'Mr. Manjinder Singh Saini, Advocate has put in appearance on behalf of the respondent and has filed his power of attorney, which is taken on record.

Learned counsel for the petitioner on instructions from the petitioner who is present in Court states that the custody of the minor child would be handed over to the respondent in Court on 29.07.2024 at 10:00 AM.

List on 29.07.2024 at 10:00 AM.'

-2Today on first call, Mr. Sukhmeet Singh, Advocate had sought permission to withdraw his vakalatnama as the petitioner wanted to argue in person.

On a query put by this Court as to whether the petitioner had brought the minor child so that the custody could be handed over to the respondent, the petitioner instead of responding to the query insisted on arguing the case. On the insistence of this Court that the petitioner should first comply with the order passed by this Court and the earlier order passed in CR-3854-2023 as well as the order of the Family Court concerned, the petitioner requested that the matter be kept at 2:00 p.m. The matter has been taken up post lunch. The petitioner is not present in Court. In the interest of justice, adjourned to 25.10.2024.

It is made clear that pendency of the present revision petition shall not be an impediment in the continuation of the proceedings before the Court concerned. Copy of this order be communicated to the Court concerned.'

Today the matter has been called twice since morning, however, none has put in appearance on behalf of the petitioner.

In view thereof, this Court is left with no other option but to dismiss the present petition for non-prosecution. 4.

Dismissed for non-prosecution. Pending applications, if any, also stand disposed off.
