The matter is taken up for hearing through video conference due to COVID-19 situation.

The present petition is filed seeking directions for transfer of investigation to a women police officer in FIR No. 199, dated 02 nd June, 2020, under Sections 452, 323, 341, 506 read with Section 148 and 149 IPC registered at Police Station Haibowal, District Police Commissionerate Ludhiana.

As per the FIR allegations are that the father and brother of the petitioner were given beatings by the accused and even the petitioner was also attacked with an intent of sexual assault. It is further alleged that a case under Section 354, 354-B and 509 IPC is made out. The grievance is that in view of the allegations the investigation of the case should be handled by a lady officer. The grievance is that in spite of making various representations dated 11 th and th June, 2020, 25 th July, 2020 and 18 th August, 2020 to various authorities, the needful has not been done.

CWP No. 13575 of 2020 - 2Learned State counsel appearing on advance notice, on instructions said that there is no female officer available in the concerned police station. However, it is stated that the Director General of Police, Punjab shall expeditiously look into the representation and decide the same in accordance with law.

In view of above, the present petition is disposed of. Let, the Director General of Police, Punjab decide the representation and also treat the present writ petition as representation. The decision be taken at the earliest but not later than 09 th October, 2020.
