Prayer in this petition, filed under Section 482 of the BNSS, 2023 (earlier Section 438 Cr.P.C.), is for grant of anticipatory bail to the petitioner, who has been booked in a criminal case arising out of First Information Report, as detailed hereunder:- Name & age of Petitioner FIR Date Section(s) Police Station District No.

After hearing the submissions advanced by counsel for the petitioner, on 29.04.2026, following order was passed:- "2.

FIR in the present case was lodged by one Balvir Singh, who is engaged in private medical practice at Talwandi Bhai. It is alleged that on 14.09.2023, at about 9:00 P.M., while the complainant

-2was travelling in his Honda City car, bearing registration No.DL-3-CBE-3798, along with his nephew Harmanpreet Singh, the accused persons arrived in two vehicles-one Swift car, bearing registration No.PB-31-G-8696 and another golden Alto car, with an erased registration number-and intercepted him.

It is further alleged that Rupinder Singh @ Bittu (present petitioner) was armed with a pistol; Kala Singh armed with a kapa; Varinder Singh @ Sonu armed with a kapa; Robin armed with an iron rod; Davinder Singh @ David armed with a kapa; Khushpreet Singh armed with a baseball bat; and Jagmeet Singh and Gurmeet Singh armed with iron rod pipes, along with 2-3 unidentified persons also armed with iron rods.

As per the prosecution, role attributed to the present petitioner is that he fired a shot in the air with his pistol. It is alleged that thereafter, his brother Kala Singh caught hold of the complainant, and accused Davinder Singh @ David inflicted a kapa blow on the back side of the complainant's head. Subsequently, present petitioner along with Varinder Singh @ Sonu and Kala Singh allegedly assaulted the complainant on his head with their respective weapons, causing him to fall to the ground, after which all the accused persons continued to beat him. FIR also discloses the motive behind the occurrence, stating that petitioner suspected the complainant of having assisted his wife-who was earlier employed at the complainant's hospital and has since divorced the petitioner.

Learned counsel for the petitioner submits that the only role attributed to the petitioner is that of firing a shot in the air, and no specific injury has been attributed to him on the person of the complainant.

On advance notice, Mr. Neeraj Madaan, Sr. DAG, Punjab, puts in appearance on behalf of the respondent - State, and produces photocopy of the report of the CT Brain dated 16.09.2023, wherein it has been mentioned that "there is fracture of the left occipital bone with overlying soft tissue swelling". 7.

After considering the fact that the motive is directly attributed to the petitioner, and co-accused, acting in concert with him while armed with weapons, caused injuries including a fracture on a vital part of the body of the complainant, this Court prima facie does not find any substantial ground to extend the

-3concession of the extraordinary relief of anticipatory bail to the petitioner.

At this stage, learned counsel for the petitioner prays for grant of some time to explore the possibility of an amicable resolution of the dispute with the complainant.

On the very outset, counsel for the petitioner prays for withdrawal of the present petition.
