CRM-M No.25978 of 2020 This is a petition that has been filed for grant of regular bail to the petitioner in FIR No.1328 dated 28.12.2017 under Sections 406, 420, 120-B IPC (Sections 409, 467, 468, 471 IPC added later on) registered at Police Station Panipat City, District Panipat. Learned counsel for the petitioner herein would contend that the matter stands settled between the parties by way of compromise, which is available on record as Annexure P-11. The parties in fact have decided to settle all disputes and in terms of compromise dated 24.09.2019, a petition for quashing of the FIR has been filed, which his numbered as CRM-M No.46068 of 2019 and pending adjudication before this Court for 28.01.2021. It is also argued that under the said FIR, the co-accused has PANKAJ KUMAR 2020.11.11 15:08 I attest to the accuracy and integrity of this document

CRM-M No.25978 of 2020 (O&M) -2already been allowed regular bail by this High Court vide order dated 22.09.2020 passed in CRM-M No.27958 of 2020, therefore, seeks concession of bail to the petitioner.

Learned counsel appearing on behalf of the respondent-State opposes grant of regular bail to the petitioner, however, she is not able to dispute the fact that the co-accused has already been allowed bail by this High Court.

I have heard learned counsel for the parties and have perused the paper book.

Keeping in view the fact that a compromise has arrived at between the parties and the co-accused has already been allowed bail by this High Court coupled with the fact that the trial is likely to take some time to conclude owing to novel corona virus pandemic situation, no useful purpose would be served by keeping the petitioner behind bars. The instant petition is allowed and the petitioner is directed to be released on regular bail on execution of personal/surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
