The petitioners have filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.26 dated 16.2.2017 registered for the offences under Sections 420, 120-B and 506 IPC at Police Station Division No.4, Ludhiana, District Ludhiana. Notice of motion has been issued in this case. Mr. V.P.S. Sidhu, learned Assistant Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioners and learned Assistant Advocate General, Punjab appearing for the respondent-State and have gone through the record.

As per the main allegations in the FIR, accused Lalit Kumar, Harpal Singh Parmar 2017.05.04 16:40 I attest to the accuracy and authenticity of this document Chandigarh

`Cr. Misc. No.M-8068 of 2017 [2] Ajay Kumar, Dheeraj Kumar and Davinder Kumar requested the complainant to give them some financial help and regarding this accused No.4 gave assurance to the complainant that the above mentioned accused Nos.1 to 3 are trustworthy persons and they would return the money. As per the demands of the above mentioned accused, the complainant gave `15,50,000/- in cash as financial help to the above mentioned accused persons from time to time. The money was given on the assurance that it would be returned soon but the main allegation is that they have not returned that money etc. The petitioners have already joined the investigation. They are not required for custodial interrogation. No useful purpose will be served by sending the petitioners to custody.

Keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, I find merit in this petition and the same is allowed. The interim order dated 9.3.2017 passed by this Court granting interim bail to the petitioners is made absolute. However, the petitioners shall join the investigation as and when called upon to do so and shall abide by the conditions of Section 438 (2) Cr.P.C. May 3, 2017.
