Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.16 dated 08.03.2017 under Section 22 of the NDPS Act, registered at Police Station Mehtiana, District Hoshiarpur.
Notice of motion was issued. Learned State counsel appeared and contested the petition.
I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that as per prosecution version, present petitioner was allegedly found in the conscious possession of 110 grams of intoxicating powder containing 'Diphenoxylate Hydrochloride', which falls VINEET GULATI 2019.03.05 10:43 I attest to the accuracy and authenticity of this document Chandigarh
CRM No.M-54169 of 2018 -2under commercial quantity. Section 37 of the NDPS Act bars the grant of bail to the accused in the case of commercial quantity. Therefore, finding no merit in the present petition, the same is dismissed.
