For the reasons recorded in the application, which is supported by an affidavit, the same is allowed and the matter is taken up for hearing today itself.

Crl.M.No.26612 of 2021 Prayer is for impleading the complainant as party respondent No.2.

Complainant, details of whom has been mentioned in head note of the application, is ordered to be brought on record as party respondent No.2.

Main case Allegations against the petitioner are that he had received a sum MANOJ KUMAR 2021.08.27 09:43 I attest to the accuracy and integrity of this document

CRM-M-31827 of 2021 (O&M) #2# of Rs.18 lacs from the complainant on the promise to send him abroad. However, neither the complainant was sent abroad nor was money returned. Learned counsel for the petitioner submits that the petitioner has entered into compromise with the complainant, a copy of which is annexed as A.1. In terms of the compromise, the petitioner has paid an amount of Rs.3 lacs to the complainant. He has also handed over fifteen post dated cheques of Rupees one lac each to the complainant. Each of the cheques is to be presented after one month.

Heard.

Without commenting anything on the merits of the case and also bearing in mind the fact of compromise having been arrived at between the parties, in my opinion, no useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is accepted. The petitioner Gurmeet Singh @ Sonu is ordered to be released on bail on her furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned. However, it is made clear that in the event of any cheque given by the petitioner to the complainant being dishonored, the bail of the petitioner is liable to be cancelled.
