Present petition has been filed under Section 482 of BNSS for grant of anticipatory bail to the petitioner in case FIR No.34 dated 13.03.2025 under Sections 21(b) and 29 of NDPS Act registered at Police Station Nathana District Bathinda.

Learned counsel for the petitioner inter alia contends that the petitioner is not named in the FIR in question and admittedly, the contraband was recovered from the conscious possession of the co-accused Amritpal Singh. Further, the petitioner has been nominated as an accused on the basis of disclosure statement suffered by the co-accused during his custodial interrogation, which has no evidentiary value in the eyes of law and as such, the petitioner is entitled to anticipatory bail. 3.

Per contra, learned State counsel has opposed the prayer made by the counsel for the petitioner on the ground that the petitioner is a habitual offender and is involved in drug trafficking in the present case. Keeping in view the antecedents of the petitioner and also the fact that the investigation is at its nascent stage, no ground is made out to grant the concession of anticipatory bail to the petitioner. Accordingly, the present petition stands dismissed.
