It is contended by learned counsel for the petitioners that the claim which the petitioners have made in the instant petition would be covered by judgment passed by this Court in CWP No. 4685 of 1996 titled as Ram Singh and others vs. State of Punjab and others decided on 06.01.2012 (Annexure P-3). It is urged that the petitioners are entitled to the same benefit as was granted to the petitioners in Ram Singh's case(supra). It is further submitted that although the petitioners have served a legal notice dated 8.7.2020 (Annexure P-8) but till date the respondents have not responded.

Having heard counsel for the petitioners and while refraining from making any expression on merits, the writ petition is disposed off with a direction to the respondent-authorities to examine the claim of the petitioners against the backdrop of the legal notice dated 8.7.2020 (Annexure P-8) and to take a final decision thereupon within a period of four months from the date of receipt of a certified copy of this order.

It is however clarified that in the eventuality of the claim of the petitioners being accepted it would be open for the respondent-authorities to limit the consequential financial benefits to a period of 38 months prior to the date of filing of the instant petition.
