NIDHI GUPTA, J. (ORAL) Prayer in this Ist petition filed under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in case FIR No. 0169 dated 16.07.2022 registered under Sections 365, 376-D, 384, 506/34 and 120-B IPC and Section 4 of the Protection of Children from Sexual Offences Act, 2012 at Police Station City 1 Malerkotla, District Malerkotla. Custody certificate 12.02.2024, filed by learned counsel for the State is taken on record.

By placing on record a copy of judgment dated 04.11.2023, passed by the learned Additional Sessions Judge, Sangrur, learned counsel for the State submits that the instant petition has been rendered infructuous, as the petitioner has already been acquitted in the present case. It is further submitted that this fact has also been mentioned in the custody certificate.

Learned counsel for the petitioner does not dispute the aforesaid fact and submits that he may be permitted to withdraw the present petition.

Permitted to do so.

Dismissed as withdrawn.
