CORAM:

HON'BLE MR. JUSTICE INDERJIT SINGH

Present:

Mr.R.S.Chauhan, Advocate for the petitioner.

Mr.V.P.S.Sidhu, Asstt. Advocate General, Punjab for the respondent-State.

**** INDERJIT SINGH, J.

Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.193 dated 26.09.2016 under Sections 307, 323, 148, 149 IPC and Section 25 and 27 of the Arms Act, registered at Police Station Patran, District Patiala.

Notice of motion was issued. Learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that the present petitioner is named in the FIR. He was armed with gun and he fired shot from the gun and caused injury on the right shoulder of Kaman Ram, father of the complainant. CRM No.M-8278 of 2017 -2Keeping in view the facts and circumstances of the present case, nature and gravity of the offence and in view of the fact that the petitioner was armed with deadly weapon and is the main accused, I do not find it a fit case where petitioner is entitled to benefit of regular bail. Therefore, finding no merit in the present petition, the same is dismissed.
