Petitioner has filed this second petition under Section 439 read with Section 482 Cr.P.C. for grant of regular bail in case FIR No.77 dated 19.11.2009 under Sections 420, 467, 468, 471 and 120-B IPC, registered at Police Station Jhunir, District Mansa.

Notice of motion.

Mr.Ajay Pal Singh Gill, DAG, Punjab, has put in appearance on behalf of the respondent-State and contested the petition. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that present petitioner is not named in the FIR and no overt act has been alleged against him. The FIR is of 2009 and petitioner was earlier declared proclaimed offender. Now, the petitioner VINEET GULATI 2019.07.03 15:07 I attest to the accuracy and authenticity of this document Chandigarh has been arrested in this case and he is in custody since 25.09.2017.

CRM No.M-24868 of 2019 -2The offences are triable by Judicial Magistrate. The petitioner is not required for any investigation or interrogation purposes as he is in judicial custody. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody till the disposal of the case.

Keeping in view the facts and circumstances of the present case and in view of the custody which is more than one year and nine months, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, the present petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal/surety bonds in the sum of `50,000/- with two sureties in the like amount to the satisfaction of the trial Court/Duty Magistrate.
