(ORAL) This is a petition that has been filed for grant of anticipatory bail to the petitioner in case FIR No.63 dated 02.06.2020 registered under Sections 323, 324, 427, 148, 149, 188 IPC (Sections 452, 326, 307 and 120-B IPC added later on) at Police Station Sadar Banga, District SBS Nagar. Learned counsel for the petitoner herein would contend that there are changed circumstances after filing of the first bail application, which necessitated the filing of the instant petition. It is argued that Section 307 IPC has been added, which is not made out as per medical report annexed along with this petition. The medical report does not state that any of the injuries suffered by the petitioner are grievous in nature.
I have heard learned counsel for the petitioner and find no ground to entertain the second bail application. As per the FIR, the petitioner herein is the main accused, who was armed with the khanda and hit the complainant on his head. The medical report would reflect that injury No.1 is incised wound of 8 cm x 1.5 cm x 1 cm with fresh bleeding present over left parieto temporal region hortizontally and injury No.3 is incised wound of 3 cm x PANKAJ KUMAR 2020.09.
CRM-M No.26130 of 2020 (O&M) -21cm x 0.6 cm deep with right lower back region. 7 cm lateral to spine (SI region). The contention that offence under Section 307 IPC is not made out is to be disputed before the trial court at the time of framing of charges. Resultantly, the instant petition stands dismissed.
