The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.163 dated 30.9.2018 registered for the offences under Sections 323, 324, 307, 148, 149 and 427 IPC and (Sections 325 and 452 IPC, which were added later on) at Police Station Sadar Jalandhar, District Jalandhar.
I have heard learned counsel for the petitioner and have gone through the record.
From the record, I find that the petitioner is named as Babu in the FIR and as per order dated 28.11.2018 passed by the learned Additional Sessions Judge, Jalandhar, during investigtion the present petitioner is found to be known as Babu. The petitioner is stated to be armed with a `Kirpan'. He gave two injuries on the right wrist of the injured and also on HARPAL SINGH PARMAR 2018.12.11 14:12 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-54416 of 2018 [2] the backside of thigh, which means the present petitioner actively participated in the commission of offence. He is required for custodial interrogation as the weapon is still to be recovered from him. The injury dangerous to life is attributed to co-accused. Keeping in view the facts and circumstances of the present case and the fact that the petitioner is required for custodial interrogation, I do not find it a fit case where the petitioner is entitled for the grant of anticipatory bail.
Therefore, finding no merit in this petition, the same is dismissed.
