**** AJAY TEWARI, J.(Oral) On 05.2.2018, the following order was passed :- "As per office report notice could not be issued to respondents No. 1, 3 to 5, 8 and 9 as the learned counsel has not furnished the correct address. The matter is pending for this purpose since 16.7.2009. Counsel prays for one more opportunity to furnish the addresses. Though there is no justification for the same yet on request one last opportunity granted to her to furnish the correct addresses but subject to cost of Rs. 2000/- to be deposited before the Mediation and Conciliation Centre of this Court. In the event of correct address is filed, fresh notice be issued to them for 25.5.2018. In the event address is not filed, the matter be listed before this Court on 26.2.2018."

Till date neither the costs has been deposited nor correct addresses of the unserved respondents have been supplied. Counsel for the appellants is not a position to deny that

In the circumstances, the appeal stands dismissed for nonprosecution. Since the main case has been decided, the pending C.M, if any, also stand disposed of.
