Mr. Sanjiv Gupta, Advocate for the respondent. *** Complainant M/s Vikson Securities Private Limited, Chandigarh had brought a complaint under Section 138 of the Negotiable Instruments Act against accused Kanchan Raheja daughter of Shri Tek Chand Chhabriya, wife of Shri Chand Raheja, resident of Flat No. 502, Leela Palace, 7/85, Tilak Nagar, Kanpur (U.P.) The accused preferred a petition under Section 482 of the Code of Criminal Procedure seeking quashing of the complaint and all consequential proceedings arising therefrom for the reason that she was ready to pay the disputed amount of `1.5 lacs. Notice of the petition was given to respondent-complainant, who put in appearance.
The matter was referred to Mediation and Conciliation Centre of this Court which has ended in an amicable settlement. Such statement bearing signatures of both the parties has been submitted before this Court. The same is accepted as Ex. C1 for the purpose of convenience. In terms of such settlement/agreement, counsel for the complainant-respondent admits this settlement/agreement having no objection if the petition is accepted and criminal complaint along with ancillary Parvinder Singh 2017.08.
CRM-M 8374 of 2017 proceedings pending in the Court of JMIC, Chandigarh are quashed. Since the matter has been compromised between the parties with the intervention of Mediation and Conciliation Centre, the petition is allowed. Resultantly, complaint under Section 138 of the Negotiable Instruments Act along with ancillary proceedings stands quashed.
