******* SURINDER GUPTA, J.(Oral) Learned counsel for the petitioner submits that trial Court has dismissed the application of the prosecution under Section 319 Code of Criminal Procedure on the ground that there is no evidence on record for summoning of respondent No.2 as additional accused. She seeks permission to withdraw the petition with liberty to file fresh application as and when the need so arise after bringing on record evidence against respondent No.2 by prosecution.
