Versus

State of Haryana and others -Respondents CORAM: HON'BLE MR. JUSTICE RAJ MOHAN SINGH

Present:

Mr. J.S. Rana, Advocate, for the petitioner.

**** RAJ MOHAN SINGH, J. (Oral) Petitioner has preferred this writ petition for the issuance of an appropriate writ, order or direction especially in the nature of mandamus directing the respondents to publish a list of work partially completed and to pay the amount which has become due to the petitioner.

Learned counsel for the petitioner submits that petitioner is an enlisted contractor in Municipal Corporation, Faridabad. Petitioner was allocated various work assignments by the Municipal Corporation, Faridabad in the year 2019-2020. Petitioner has already completed the work assignment as per specifications of respondent No.3. Respondent No.3 has also sought release of funds from the

-2competent authority. The bills submitted by the petitioner have been duly audited and passed by the competent authority, but necessary payments have not been released, despite a representation dated 06.07.2021 moved by the petitioner to respondent No.3.

Owing to inaction on behalf of respondent No.3, petitioner even supplemented his earlier representation by way of reminder dated 03.03.2022 but the same has also met with the same fate. Petitioner has again filed latest reminder on 04.04.2022, but of no avail.

Learned counsel for the petitioner submits that at this stage, the petitioner would be satisfied in case its representation including reminders is directed to be decided by the respondents by passing a speaking order in accordance with rules and procedures at the earliest and if the entitlement of the petitioner is established, then the needful in the context of payment be made.

Notice of motion.

On the asking of the Court, Mr. Vivek Chauhan, Addl. A.G., Haryana accepts notice on behalf of the respondents. Without meaning anything on the merits of the case, this writ petition is disposed of with a direction to respondent No.3 to take note of pending representation and reminders of

-3the petitioner and pass appropriate order in accordance with law, preferably within a period of two months from the date of receipt of certified copy of this order.
