Petitioner, who is running Prince Vaishno Dhaba since 1996, has approached the Court with a grievance that a diversion marked as 'XY' located on slip road at National Highway No. 54 as is depicted from the site plan, Annexure P-3, is being closed.

Upon notice, writ petition has been contested by National Highway Authority of India (NHAI)-respondents No.1 to 4, by filing a response, wherein it has been stated that access to the National Highway is unauthorized. Reference has been made to Section 29 (4) of the Control of National KAMAL SHARMA 2025.11.21 18:00 I attest to the accuracy and authenticity of this order/judgment.

CWP-15054-2021 -2Highways (Land and Traffic) Act, 2002 to submit that NHAI has been empowered to remove unauthorized accesses to a highway by passing appropriate orders and use of necessary force with the assistance of police, if required. A stand has been that petitioner has filed the instant petition with the ulterior motive to regularize an unauthorized access to National Highway No.

54. Reference has also been made to a communication dated 21.11.2024, Annexure R-1, to submit that diversion has been made by the petitioner without obtaining permission or a No Objection Certificate from NHAI. 3.

In view of the categoric stand taken by respondents No.1 to 4, there is no merit in the writ petition, which is dismissed with no order as to costs.
