ARVIND SINGH SANGWAN, J. (Oral) The petitioner prays for grant of anticipatory bail in complaint case No.21 of 2014 dated 23.11.2013, filed under Sections 323, 326, 149 of the Indian Penal Code (in short 'IPC'). The operative part of the order dated 10.12.2018, vide which interim anticipatory bail has been granted to the petitioner, is reproduced as under:- "....Learned counsel for the petitioner submits that the petitioner was granted regular bail and was regularly appearing before the trial Court. However, on 17.07.2018, the petitioner could not appear before the Court and moved an application for exemption but the same was declined and the bail/surety bonds were forfeited. Learned counsel for the petitioner submits that in fact the petitioner is a student of BA Final Year and is studying in Chandigarh. On that account, he had moved an application for exemption. Learned counsel further submits that the petitioner is ready to surrender before the trial Court and apply for fresh bail.

Counsel for the petitioner has submitted that, in pursuance to the order dated 10.12.2018, the petitioner has deposited the costs of Rs.5,000/- with the District Legal Services Authority, Moga and he has been released on interim bail. A copy of the receipt as well as the order dated 11.12.2018 is taken on record as Mark Y. Counsel for the State, on instructions from the Investigating Officer, has not disputed the aforesaid fact. In view of the above, this petition is allowed and the interim bail granted to the petitioner vide order dated 10.12.2018 is made absolute subject to the conditions envisaged under Section 438(2) Cr.P.C.
