Present 6th petition (Second for interim bail) has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of interim bail for 01 month to the petitioner in case FIR No.441 dated 24.7.2021 under Sections 364 of IPC (Sections 302, 201 and 34 of IPC added later on), registered at Police Station Rai, District Sonipat.

On the strength of advance copy, Ms. Priyanka Sadar, Senior DAG, Haryana has entered appearance on behalf of the respondent/State. 3.

Learned counsel for the petitioner while iterating the cause of the petitioner has argued that the petitioner was earlier granted the interim regular bail for a period of 15 days vide order dated 9.4.2026 passed in ASHWANI KUMAR 2026.04.29 17:30 I attest to the accuracy and integrity of this document

CRM-M No.23537 of 2026 -2CRM-M No.16501 of 2026 & the medical condition of the father of the petitioner is still precarious . Learned counsel has further submitted that the petitioner after availing the concession of said interim bail, shown his bona fide by surrendering back to custody.

Keeping in view the facts and circumstances of the case, especially the conduct of the petitioner that he has surrendered back to custody after availing the period of interim bail and no misuse of this concession has been brought forth, the petitioner is directed to be released on interim regular bail for a period of 3 weeks commencing from tomorrow i.e. 30.4.2026, subject to the satisfaction of the concerned Illaqa Magistrate/CJM/Duty Magistrate.

The petitioner shall cause appearance before the concerned Court/CJM after expiry of 21 days. In case, the petitioner does not do so, the concerned Court/CJM shall take immediate steps to take him back to custody.
