The petitioners, who were working as SPOs, seek the relief of absorption as regular constables on the ground that they have been found suitable. The relief has been declined on account of the fact that there was a criminal case registered against them in which they stood acquitted. The order for merging the petitioners as SPOs to the post of Sepoy has been taken back vide order dated 03.07.2010 (Annexure P-2). In view of the detailed reasons given in judgment of even date passed in CWP No. 14975 of 2009, Pawan Kumar (Constable) vs. State of Punjab and others, the said order is set aside. Accordingly, directions are issued to respondent no. 2 to consider the case of the petitioners for absorption as Constables within a period of 3 months from the date of receipt of certified copy of the order. It is, however, made clear that the petitioners will not be entitled for any monetary benefits during the period they remained out of service.
