Petitioner has impugned order dated 10.08.2020, Annexure P-1, passed by Commissioner, Gurugram Division, Gurugram, whereby his plea for release on parole for house repair has been rejected. According to him, all the pleas raised by him have not been considered by the concerned authority.

We, thus, propose to remit the matter to the same authority for decision afresh after affording an opportunity of hearing to the petitioner or his counsel. The proposal is acceptable to the State counsel. It appears th at ratio of judgments in 'Rakesh versus State of Haryana and others (CWP8565-2018)', 'Dharambir versus State of Haryana and others, (CWP-94582018)' and 'Gurdeep Singh versus State of Haryana and others, (CRWP1374-2017, decided on 07.12.2017)', needs to be considered by the concerned authority apart from other submissions.
