Learned counsel for the petitioner submits that the petitioner may be permitted to withdraw the present petition with liberty to file a petition under the provisions of Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023.

For the reasons mentioned in the application, which is duly supported by an affidavit of the petitioner and keeping in view the statement given by learned counsel for the petitioner, the application is allowed and the present petition is dismissed as withdrawn with liberty aforesaid, in accordance with law.
