The instant petition has been filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in case FIR No.78 dated 13.12.2018 registered under Sections 406, 498-A IPC at Police Station Samalsar, District Moga.

By an order dated 12.02.2020, while observing that gold items have not been recovered, this Court directed the complainant to supply complete list of gold items to the investigating officer. 3.
Counsel for the petitioner would contend that in pursuance to order dated 12.02.2020, petitioner has returned all the gold items. 4.
Learned counsel appearing on behalf of the respondent-State on instructions from IO admits to the factum of recovery of gold items from the petitioner.

In view of the fact that the petitioner has returned all dowry articles including gold items, this Court deems it appropriate to grant anticipatory bail to the petitioner, subject to the conditions laid down in Section 438 (2) Cr.P.C. However, it is made clear that the petitioner would cooperate with the investigation as and when so required and in case of any default on the part of the petitioner, the respondent-State will have liberty to move an appropriate application for cancellation of anticipatory bail granted to him.
