By way of this petition filed under Section 482 of Cr.P.C., 1973, the petitioners are seeking quashing of FIR No.265 dated 24.07.2021 for offence punishable under Sections 406, 420 of IPC, 1860 wherein offence under Section 120-B IPC was added later on registered at Police Station Old Faridabad, Faridabad (Annexure P-1) and consequential proceedings arising therefrom, on the basis of affidavit dated 16.05.2024 of the complainant/respondent No.2 (Annexure P-2).

Vide order dated 23.05.2024 of this Court, the parties were directed to appear before the learned trial Court/Illaqa Magistrate on 31.05.2024 for getting their statements recorded regarding the compromise arrived at between them and the Court concerned was further directed to get the statements of the parties recorded qua the compromise so arrived at between them and to submit a report in this regard.

Copy of report has since been received from learned Judicial Magistrate Ist Class, Faridabad in pursuance of the directions of this Court, wherein, the factum of the compromise arrived at between the parties stands verified and confirmed. As per the report, compromise has indeed been effected between the parties and the same is without any pressure or coercion and out of their free will and the complainant has also made a statement to the effect that he would have no objection if the FIR qua the accusedpetitioners is quashed. 4.
The Trial Court has annexed a copy of the statement of the respondent-party so recorded, alongwith its report. 5.
Learned State counsel also submits that there is no accused person other than the petitioners, and respondent No.2 is the only aggrieved persons in the FIR in question. The petitioners are not involved in any other case.

In view of the report of the learned Judicial Magistrate Ist Class, Faridabad and the principles laid down by Hon'ble the Apex Court in Gian Singh Vs. State of Punjab and others (2012) 10 SCC 303, and also by the Full Bench of this Court in Kulwinder Singh and others Vs. State of Punjab and another, 2007(3) RCR (Criminal) 1052, the instant petition is allowed and FIR No.265 dated 24.07.2021 for offence punishable under Sections 406, 420 of IPC, 1860 wherein offence under Section 120-B IPC was added later on registered at Police Station Old Faridabad, Faridabad (Annexure P-1) and consequential proceedings arising therefrom, are quashed qua the petitioners subject to payment of costs of Rs.10,000/- to be paid to the High Court Civil Dispensary.
