***** RAMENDRA JAIN, J. (ORAL) In compliance of order dated 30.08.2018 and in view of law laid down by the Hon'ble Supreme Court in "Damodar S. Prabhu v. Sayed Bablal H.", 2010(2) RCR (Criminal) 851, learned counsel for the petitioner has produced the receipt with regard to deposit of Rs.22,500/- with the registry.

Learned proxy counsel for respondent No.2 submits that he has no objection with the acceptance of instant revision petition and setting aside of order dated 15.07.2011 passed by ld. Additional Sessions Judge, Sri Muktsar Sahib, dismissing the appeal filed by the petitioner and judgment dated 15.12.2009 passed by Judicial Magistrate, Ist Class, Sri Muktsar Sahib holding the petitioner guilty under Section 138 of the Negotiable Instruments Act, and sentenced to undergo rigorous imprisonment for a SONIKA 2018.11.02 18:02 I attest to the accuracy and authenticity of this document Chandigarh

CRR No.3165 of 2016 --2-- period of two years and to pay fine of Rs.5000/-, in default thereof, to further undergo simple imprisonment for a period of three months. Considering overall facts and circumstances and also the fact that matter has been compromised between the parties, impugned judgment dated 15.07.2011 of first appellate court and that of impugned judgment dated 15.12.2009 of trial court are set aside and accordingly, complaint of respondent No.2 is dismissed as having been compromised. Disposed of.
