***** Rajan Gupta, J. (Oral) This petition has been filed under Section 439 Cr.P.C. seeking regular bail to the petitioner in a case FIR No.265 dated 08.12.2017 under Sections 22/61/85 of NDPS Act, registered at Police Station Kartarpur, Jalandhar (Rural).

Learned State counsel submits that FSL report has been received. It has been found that petitioner was in possession of 50 Grams of Alprazolam. Admittedly, same is non-commercial in nature. Petitioner is incarcerated since 08.12.2017.

Keeping in view aforesaid contentions, period of her incarceration and the fact that trial may still take some time to conclude, no useful purpose would be served by detaining the petitioner any longer. Thus without expressing any opinion on the merits of the case, this petition is allowed. Petitioner is directed to be enlarged on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Jalandhar.
