Seeking quashing of the order dated 02.02.2017, passed by the Judicial Magistrate, Chandigarh, petitioner has come up before this Court by filing the present petition under Section 482 CrPC.

Counsel for the petitioner submits that in compliance to the order dated 24.05.2024, he is unable to get the address of the respondent, however he may be permitted to withdraw the present petition with liberty to file a fresh after getting the fresh address.

This Court is of the opinion that simply because there is no statutory provision or facility for the complainant to get the address of the accused and the proprietorship firm, on this ground alone complainant who is victim, cannot made to suffer. 4.

Given above, present petition is disposed of with clarification that as and when the petitioner is able to get the address of the respondent, he is at liberty to file a fresh petition. It is clarified that time for which the present petition was pending, shall not be counted for the purpose of limitation and filing and withdrawal of the present petition shall not come in the way of filing fresh petition. All pending applications, if any, stand disposed.
