(ORAL) The instant petition has been filed under Section 482 Cr.P.C. for quashing of FIR No.18 dated 13.02.2024 under Section 174-A of the IPC registered at Police Station Sector 36, Chandigarh, and order dated 16.10.2019 passed by learned JMIC, Chandigarh in complaint No.NACT-17588 dated 14.09.2018, whereby the petitioner was declared proclaimed offender.

At the outset, learned counsel for the petitioner submits that she would not press her prayer with respect to quashing of the aforementioned FIR and the same may be dismissed as not pressed with liberty to take recourse to the alternate remedy available to the petitioner under the provisions of law at appropriate stage. 3.

Ordered accordingly.

Learned counsel submits that she would restrict her submissions to being granted seven days time to the petitioner to appear and surrender before the trial Court in complaint case. Mr. Abhinav Gupta, Additiona Public Prosecutor, U.T. Chandigarh, accepts notice on behalf of respondent No.1. 7.

In view of the limited prayer made by the learned counsel for the petitioner, the instant petition is disposed of with directions to the petitioner to appear and surrender before the trial Court within seven days from today. Till then, no coercive steps be taken against the petitioner. This shall, however, be subject to payment of costs in the sum of `10,000/- to be deposited with the State Legal Services Authority, Chandigarh.

It is made clear that in case, the petitioner fails to surrender before the trial Court within seven days from today, this order shall be of no avail to him thereafter. In case, on appearance and surrender, the petitioner moves an application for bail, the trial Court shall make earnest efforts to decide it expeditiously, in accordance with law.
