***** RAJ MOHAN SINGH, J .(Oral) The petitioner seeks grant of anticipatory bail in case bearing FIR No.52 dated 23.08.2017, registered under Sections 419, 420, 465, 468, 471 and 120-B of Indian Penal Code and under Section 13(1) read with Section 13(2) of the Prevention of Corruption Act at Police Station Kalanaur, Gurdaspur. Petitioner is a field officer who is still serving in the bank. In the departmental proceedings conducted by the bank, no incriminating material was found against the petitioner. CRM-M-24799-2019 (O&M) -2Additional Sessions Judge, Gurdaspur, while declining prayer for anticipatory bail, it has been observed that the petitioner was field officer of the bank and he was duty bound to disclose real facts before sanctioning and disbursement of the loan. Had he been invigilant, the fraud could have been avoided. At the time of issuance of notice of motion, petitioner was directed to be released on interim bail subject to his furnishing personal bonds and surety bonds to the satisfaction of the Arresting/Investigating Officer.
Learned State counsel on instructions from Inspector Vijay Pal Singh states that the petitioner has joined the investigation.
In view of the statement made by learned State counsel, order dated 29.05.2019 passed by the Coordinate Bench is made absolute, however petitioner shall abide by the conditions as envisaged under Section 438 (2) Cr.P.C. Petition stands disposed of.
