The petitioner assails order dated 28.8.2020 (Annexure P-7) passed by respondent No.3-Deputy Commissioner-cum-Chairman House Allotment Committee, District Administrative Complex, Ferozepur whereby house allotted to the petitioner vide order dated 25.8.2020 (Annexure P-2) has been cancelled on the ground that it is the Divisional Commissioner, Ferozepur who is competent to make such allotment.

Having heard learned counsel for the petitioner, the petition is disposed off with a direction that in case the petitioner makes a representation to the GAURAV SOROT 2020.09.04 14:34 I attest to the accuracy and integrity of this document

( 2 ) CWP-13570-2020 Deputy Commissioner-cum-Chairman House Allotment Committee, District Administrative Complex, Ferozepur, he shall forward the same to the authority competent for allotment of house in question and such competent authority shall consider the request of the petitioner and pass an appropriate order as to whether the petitioner is entitled for allotment of such house or not as per rules.

Such order be passed expeditiously, preferably within a period of one month from today. In case, it is found that the petitioner is not entitled for allotment of the house in question, he shall be afforded at least 3 months time for vacating the house in question. The petition stands disposed of accordingly.

It is also hoped that the Divisional Commissioner, Ferozepur shall also looked into as to how the order in question came to be passed by the Deputy Commissioner-cum-Chairman House Allotment Committee, District Administrative Complex, Ferozepur in case the said Deputy Commissioner, Ferozepur was not competent to pass such orders.
