RAMENDRA JAIN, J. (ORAL) Custody certificate filed in Court today is taken on record. At the outset, learned counsel for the petitioner contends that she does not challenge the impugned judgment of conviction dated 16.10.2013 of the trial Court and judgment dated 18.08.2016 of the First Appellate Court, affirming the same on merit. However, leniency may kindly be taken qua order of sentence, considering that the alleged crime was committed by the petitioner in the year 1994. FIR was lodged after inordinate delay of four years in 1998. Thereafter, trial concluded in the year 2013 and the appeal was decided in the year 2016. Therefore, the petitioner has already suffered a protracted trial for around 18 years. Petitioner already retired in the year 2014 and now he is leading a retired life. His one leg has also been amputated being a diabetic patient.

Considering above-mentioned submissions and circumstances, impugned judgments of conviction of the petitioner are upheld. However, order of sentence dated 16.10.2013 is modified to the

Chief Judicial Magistrate, Batala, is directed to issue arrest warrants of the petitioner, who is on bail, to undergo remaining part of the sentence. With the observations made above, the present petition is disposed of.
