Court/Illaqa Magistrate, after recording their statements, shall submit its report with regard to genuineness of the compromise viz-a-viz. number of accused persons involved in this case and whether any of the accused has been declared proclaimed offender or not, on or before the adjourned date." As per the report of the Sub Divisional Judicial Magistrate, Dasuya, dated 03.04.2017, the compromise effected between the parties is not genuine.
In this view of the matter, no further orders are required to be passed by this Court. However, the parties are free to avail the remedies before the Trial Court at an appropriate stage since an untraced report is pending adjudication before the Court of the Illaqa Magistrate. The present petition is hereby disposed of.
