HARSIMRAN SINGH SETHI, J.(ORAL) Present petition has been filed alleging the violation of the order passed by this Court dated 18.03.2019 in CWP No.7308 of 2019. Learned counsel for the petitioners submits that a direction was issued by this Court to the respondents to decide the legal notice given by the petitioners dated 16.01.2019 within a period of three months and in case, after the decision, petitioners are found entitled for the relief, the same should also be paid within a period of three months thereafter but, despite the fact that more than one and half year has elapsed since the passing of the order, neither the legal notice has been decided nor any relief has been given to the petitioners and therefore, the respondents have intentionally and willfully disobeyed the order passed by this Court dated 18.03.2019 in CWP No.7308 of 2019 and have made themselves liable to be proceeded against under the Contempt of Courts Act, 1971.

COCP-1799-2020 Ms. Rajni Gupta, learned Additional Advocate General, Haryana, who has joined the proceedings through video conference, keeping in view the service of advance copy of petition, accepts notice on behalf of the resp ondents.

Learned counsel for the respondents submits that the issue in hand was raised by many of the employees by filing writ petitions and the litigation on this issue was pending before the competent Court of law and the same has recently attained the finality and she has instructions to state that the representation of the petitioners will be decided in accordance with law within a period of one month from today and in case, it is found that the petitioners are entitled for any monetary benefits in pursuance to the decision taken on the legal notice of the petitioners, the same will also be released to the petitioners within a period of three months thereafter. Learned counsel for the petitioners submits that keeping in view the undertaking recorded on behalf of the respondents above, the grievance of the petitioners stands redressed and he does not wish to press this petition any further.

It is made clear that in case there is any default of the undertaking recorded above, the serious view will be taken by this Court, if brought to the notice.
