ANIL KSHETARPAL, J(Oral) This is the petitioner's 5th attempt to get bail during the pendency of the trial arising from case FIR No.79, dated 18.06.2019, registered under Section 22 of Narcotic Drugs and Psychotropic Substances Act, 1985, at Police Station Ding, District Sirsa, Haryana. As per the case of the prosecution, the petitioner was found to be in conscious possession of 6080 capsules/tablets containing prohibited substances specified in the Narcotic Drugs and Psychotropic Substances Act, 1985. The learned counsel representing the petitioner contends that the petitioner has already suffered incarceration for a period of more than three years but the trial of the case has not made any substantial progress.
The learned counsel representing the State submits that out of 15 prosecution witnesses proposed to be examined, only one has been examined and the case is now fixed for 22.07.2022. No doubt, due to the widespread outbreak of Covid-19, the working of the Courts was adversely affected for a period of nearly one and a half year.
