(ORAL) The instant second petition has been filed under Section 528 of BNSS seeking quashing of information letter (notice) dated 05.01.2025, issued by Station House Officer, Police Station Sirsa, Haryana (Annexure P1) and the proceeding in case bearing No.COMI-127-2025, dated 06.05.2025, titled as "State V. Poonam Bansal" under Section 215 of BNS (Annexure P-2), including all the orders, arising out of cancellation report dated 02.10.2022 submitted in FIR No.352, dated 03.05.2022, registered under Sections 354-A, 354-D and 509 of IPC and Section 67 of IT Act. Learned counsel for the petitioner submits that the instant FIR was got lodged by the petitioner on the basis of genuine allegations, which are backed by substantial evidence, including screenshots and recording. -2fides filed a cancellation report in the said FIR, on the strength of which the proceedings under Section 215 BNS were also instituted against the petitioner. Accordingly, the same deserves to be quashed. 3.

Learned State counsel has filed status report by way of affidavit of Deputy Superintendent of Police, Sirsa, District Sirsa, on behalf of the State, which is taken on record. While placing reliance on the status report, she submits that the petitioner has a long history of instituting multiple criminal proceedings against different individuals by levelling similar allegations. As per the official records, the petitioner has got lodged as many many as 15 cases, including the present FIR, most of which were subsequently found to be false. It is further submitted that the present case was thoroughly investigated by the police authorities in accordance with law. During the course of investigation, the statements of relevant witnesses were recorded, the surrounding circumstances were examined and all available evidence was carefully scrutinized. Upon completion of the investigation, vide Dairy dated 26.09.2022 by Sh. Sadhu Ram, HPS, the then Deputy Superintendent of Police, Sirsa, the allegations levelled by the petitioner against the accused Manoj Hans were found to be false, baseless and motivated, arising out of a monetary dispute between the parties. Consequently, the Investigating Officer/Competent Authority prepared a cancellation report vide Diary dated 02.10.2022 and processed the same for necessary approval as per rules.

The Cancellation report was then submitted before the learned Area Magistrate on dated 15.07.2024 registered under UCR-5055-2024. The proceedings on the cancellation report are now pending for 17.08.2026 for the preliminary evidence of the complainant/petitioner qua proposed protest petition under that Cancellation report.

A perusal of the record reveals that the FIR in question was subjected to detailed investigation by the competent authorities, which, upon a careful consideration of the material collected at the time, found the allegations levelled by the petitioner as being false and motivated.

-5Accordingly, a cancellation report dated 02.10.2022 was prepared and submitted, proceedings whereupon are pending for preliminary evidence of the petitioner qua the proposed protest petition filed thereagainst. 8.

The material paced on record further reflects that besides getting lodged the present FIR, the petitioner had also levelled identical allegations against different individuals in numerous complaints/FIRs, in some of which proceedings under Section 182 IPC/217 BNS have even been instituted against her for furnishing false information. Though, this Court refrains from expressing any opinion on these antecedents, nevertheless the same lend credence to the prima facie satisfaction recorded while initiating the kalendra proceedings.

Moreover, learned counsel for the petitioner has also not been able to point out any procedural illegality, jurisdictional error or abuse of the process of law, which would warrant interference by this Court. 10.

Under such circumstances, no ground is made out for this Court to exercise its inherent powers to quash the proceedings initiated against the petitioner in FIR No.352 dated 03.05.2022.
