Notice of motion had been issued in this writ petition primarily on the ground that the Officer who had passed order dated 19.04.2018 (Annexure P-1), had heard and decided the appeal filed by the petitioner and passed order dated 30.01.2019 (Annexure P-2). Learned counsel for the respondents, on instructions submits that order dated 30.01.2019 be treated as withdrawn with liberty to the respondents to decide the matter afresh by the competent authority. It is submitted that appeal shall be decided expeditiously and in all probability within two months.

Keeping in view the submission as above, learned counsel for the petitioner does not press this writ petition at this stage. Accordingly, this writ petition is dismissed as not pressed. Needless to say, in case of any dispensation against the petitioner in appeal, he is at liberty to challenge the same in accordance with law.
