(ORAL) Learned counsel for the respondent has placed on record the copy of the affidavit dated 04.04.2022 of the respondent. As per this affidavit, respondent-Moreen Kaur was engaged to one Keshwant Lal in Fiji. In the year 2013, she moved to New Zealand and in August, 2016, she and Gurinderpreet Singh became friends. She told about her engagement with Keshwant Lal to him and also filed a petition for seeking divorce from Keshwant Lal in the Court. The divorce papers were sent to Gurinderpreet Singh on 30.09.2016. When she came to India, Gurinderpreet Singh knew about her previous marriage with Keshwant Lal. She met family members of Gurinderpreet Singh and on their persuasions, she agreed for a roka ceremony but she

was not aware that her marriage was being performed as per Sikh culture in a Gurudwara and thereafter, they have exchanged their rings in a Hotel. After this celebration, she had signed some papers for the registration of her marriage. Her passport was kept by the family of Gurinderpreet Singh and she was told to come back in the year 2017 to perform a legal marriage. She has no objection if the so called marriage comes to an end as she has no relationship with Gurinderpreet Singh. This affidavit has been attested at Auckland, New Zealand. A perusal of the affidavit shows that the respondent participated in her roka ceremony but actually she was not aware that the marriage ceremonies have been performed. Moreover, she has no relationship with the appellant as she left for New Zealand in the year 2016.
Appellant Gurinderpreet Singh is present in the Court today and his statement has been reduced into writing wherein he has stated that he has not initiated any other proceedings against the respondent in any Court of law and will not initiate any proceeding against her after the decision of the present appeal.
In view of above, no case is made out to keep this matter pending now. Accordingly, the present appeal is hereby allowed and the judgment and decree dated 09.05.2019/10.05.2019 are hereby set-aside. The marriage of appellant-Gurinderpreet Singh with respondent-Moreen Kaur is declared as null in the light of the affidavit. In case, the respondent comes to India and wants to get this order recalled, she can

do so within a period of six months. All the pending applications stands disposed of .
