Karan Mangla v. State Of Punjab And Others
IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH CRWP-4914-2024 Date of Decision : July 15, 2024 KARAN MANGLA -PETITIONER V/S STATE OF PUNJAB AND OTHERS -RESPONDENTS
CORAM:
HON'BLE MR. JUSTICE KULDEEP TIWARI
Present:
Mr. Yagsimant Attri, Advocate for the petitioner.
Mr. Pardeep Bajaj, D.A.G., Punjab.
*** KULDEEP TIWARI, J. (ORAL) 1.
Through the instant petition, as filed under Article 226 of the Constitution of India, the petitioner seeks issuance of directions upon the respondents No.2 and 3, to ensure protection of his life and liberty, at the hands of the respondents No.4 and 5.
2.
On the last date of hearing, i.e. 28.05.2024, this Court had requisitioned a reply from the learned State counsel, which has accordingly been placed on record today by the latter, on affidavit of Satvir Singh, PPS, Deputy Superintendent of Police (SD), Barnala. 3.
What emerges from a survey of the reply (supra) is that, neither the alleged threat perception was ever reported to the official respondent(s) concerned, nor the alleged threat perception actually exists. The petitioner does not have any threat or danger to his life and liberty. 4.
In view of the disclosures made in the reply (supra), the DEVINDER YADAV 2024.07.15 17:40 I attest to the accuracy and authenticity of this order/judgment
CRWP-4914-2024 learned counsel for the petitioner submits that he does not want to press the instant petition at this stage. However, he seeks liberty to re-access this Court, in case the petitioner perceives any threat to his life and liberty in future.
5.
Consequently, the instant petition is dismissed as withdrawn, however, with liberty (supra).
