Apprehending arrest in the FIR captioned above, the petitioner-accused has come up before this Court under Section 438 CrPC. 2.
At the outset, State's counsel submits that the present petition is not maintainable under Section 438 CrPC for the reason that the petitioner is a proclaimed offender in this FIR.

At this stage, counsel for the petitioner seeks withdrawal of the present petition with liberty to challenge the PO order as well as filing a fresh petition for bail at appropriate stage.

The present petition is disposed of, having been withdrawn with liberty aforesaid. It is clarified that filing or withdrawal of the present petition before this Court shall not come in the way of the petitioner in case he files a fresh bail petition.
