JASGURPREET SINGH PURI , J. (ORAL ) The present petition has been filed under Article 226 of the Constitution of India with a prayer for issuance of necessary directions to official respondents to protect the life and liberty of petitioner No.1 and her friend namely Raj Singh by providing adequate security. At the outset, learned counsel appearing for the petitioners has submitted that the matter has since been compromised and there is no threat to the petitioner and he may be permitted to withdraw the petition.

Learned State counsel has filed reply by way of affidavit RAJ KUMAR ARORA 2021.09.17 17:35 I attest to the accuracy and integrity of this document

CRWP-7477-2021 (O&M) of Deputy Superintendent of Police, Sub Division, Jalalabad, District Fazilka, which is taken on record.

In para 4 of the affidavit, it has been stated that at present there is no threat to the life and liberty of the petitioners at the hands of private respondents as revealed during enquiry and in future also, in case the petitioners apprehend any danger, they may approach the police and necessary police protection will be provided to the petitioner as the situation warrants and therefore, no cause of action has accrued to the petitioners to file the present petition.

Relevant para 4 of the affidavit reads as under:- "That at present, there is no danger to the life and liberty of the petitioners at the hands of the private respondents as revealed during the enquiry. However, if in future, the petitioners apprehend any danger and they approach the police, the necessary police protection will be provided to the petitioners as the situation so warrants. As such, no cause of action has accrued to the petitioners to file the present petition."

In view of above, the prayer made by the counsel appearing on behalf of the petitioners for the withdrawal of the present petition is accepted.

Dismissed as withdrawn.
