This petition has been filed under Section 528 B.N.S.S. read with Section 482 Cr.P.C. for setting aside the order dated 04.04.2026 passed by JMIC-6, Abohar vide which the petitioner has been declared as proclaimed offender in FIR No. 126 dated 12.08.2020 under Sections 379,411 of IPC (303 and 317 of BNSS) registered at Police Station Bahavwala, District Fazilka. 2.
Learned counsel for the petitioner submits that the petitioner could not appear before the ld. trial Court as he was busy for the treatment of his wife who is suffering from HIV disease and is under treatment. As such the learned trial Court vide order dated 04.04.2026, declared the petitioner as proclaimed offender. He further prays that the petitioner is ready and willing to join the proceedings before the Court and the impugned order declaring the petitioner proclaimed offender be set aside.

On the asking of the Court, Mr. P.S.Pandher, Asst. A.G.Punjab accepts notice on behalf of the respondent-State. 5.
I have heard learned counsel for the parties and gone through the case file.

In view of the limited prayer made by the petitioner and without issuing the notice to respondent No.2, this Court does not find any legitimate ground to interfere in the impugned dated 04.04.2026 passed by JMIC-6, Abohar . However, in case the petitioner surrenders before the trial Court within a period of 07 days from and moves an application for grant of regular bail, the trial Court is directed to consider and decide the application within a period of three days.
