The petitioner is seeking the concession of anticipatory bail in FIR No.78 dated 20.04.2020 registered under Sections 302, 34 and 120-B of Indian Penal Code, 1860 at Police Station Bahuakbarpur, District Rohtak.

Vide order dated 27.05.2024, the petitioner had been directed to appear before the trial Court and was directed to be admitted on interim bail on his furnishing bail bonds to the satisfaction of the trial Court. The relevant part of the said order reads as under:- "Meanwhile, the petitioner is directed to appear and surrender before the Trial Court within seven days and on his appearance the petitioner shall be admitted to interim regular bail subject to his furnishing bail bonds to the satisfaction of the Trial Court. The petitioner is directed to place on record the copy of the order of the Trial Court granting him interim bail on the next date of hearing." 3.

Learned State counsel, on instructions, does not dispute the factum of the petitioner having appeared before the trial Court. 5.

In view of the above, the petition is allowed and interim order dated 27.05.2024 is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C.
