(Oral) This revision has been filed against concurrent conviction of the petitioner for the commission of offence under Section 61(1) of the Punjab Excise Act, 1914 whereby the petitioner was sentenced to undergo rigorous imprisonment for a period of six months and to pay fine of Rs. 1000/- and in default of payment of fine to undergo rigorou imprisonment for a period of six months by the trial Court whereas his sentence was reduced to that of rigorous imprisonment for three months by the Appellate Court.

Custody certificate by way of affidavit of Amrik Singh, Deputy Superintendent, Sub Jail, Fazilka has been filed and the same is taken on record.

Learned counsel for the petitioner has argued that he does not dispute this revision on merits but prays that some leniency be shown in the sentence.

  As per custody certificate the petitioner has already undergone imprisonment for a period of 1 months and 17 day as of now Learned DAG has argued that keeping in view the antecedents of the petitioner and the fact that he is not a habitual offender, he has no objection if his sentence is reduced.

In the circumstances, even while dismissing this petition, I reduce the sentence of the petitioner to that of already undergone by him. He be released forthwith if not required in any other case. Since the main case has been decided, the Criminal Misc. Application, if any, also stands disposed of.
