The present civil writ petition has been filed by the petitioner under Articles 226/227 of the Constitution of India for quashing the order dated 01.02.2013 (Annexure P-12) vide which the claim of the petitioner for appointment as Physical Training Master has been rejected.

It is contended that despite the petitioner being higher in the merit has not been appointed on the post of Physical Training Master.

At the outset, the learned State counsel submits that SANJAY 2019.01.08 16:28 I attest to the accuracy and integrity of this document

CWP No. 10363 of 2013 -2the merit of the last recommended candidate was 146.69 whereas, the merit of the petitioner was 145.37, therefore, the name of the petitioner did not find mention the zone of selection. In so far as respondent No.4, Gurpreet Singh is concerned, on re-examination, his merit stood at 127.58, therefore, his name was also not recommended. In view of the fact that the last selected candidate scored more marks than that of the petitioner, nothing survives in the present civil writ petition. Consequently, the same is hereby dismissed. 13.12.2018.
