Counsel for the petitioner has argued that the petitioner could not serve the witness due to the circumstances beyond his control. Apart from that cheque amount of 5 lacs, the petitioner would have no objection in depositing the interest amount on that (for the period that the trial has been delayed) in the Court as conditional costs. Notice of motion for 11.12.2015. Let the respondent be served by way of dasti process through his counsel in the trial Court."
Learned counsel appearing for the respondent-complainant states that the petitioner is knowingly delaying the proceedings. In my opinion in view of the statement made on the last date the other side can be compensated. CRR-4716-2015 -2wants to examine on the next date which is stated to be 21.12.2015, he would be permitted to examine him. The amount of Rs. 20,000/- will be put in a fixed deposit by the Court to be handed over to the party found successful in the complaint. It is made clear that no further opportunity would be granted to the petitioner as stated by learned counsel. Petition stands disposed of in the above terms.
