JASWANT SINGH, J (ORAL) The petitioner on attaining the age of superannuation on 31.07.1993 retired from the rank of Senior Assistant with the office of Commissioner, Patiala Division, Patiala i.e revenue Department. He is seeking quashing of impugned order dated 01.10.2012 (P.12) whereby the previous order dated 12.6.2012 (P.10) determining his seniority by counting the previous service rendered by him in the Consolidation Department, has been withdrawn. Upon notice, reply by way of an affidavit of the D.C Sangrur has been filed on behalf of respondent Nos.1 to 4 wherein it is stated that the petitioner was working as Muhrar in the Consolidation Department prior to his joining the Revenue Department in the office of Deputy Commissioner, Sangrur on 14.9.1964, where his services were confirmed as Clerk on 12.4.1973. It is further alleged that the petitioner was a retrenched employee from the Consolidation Department and after his absorption, he has been given the benefit of his previous service

CWP No.10410 of 2013 #2# with the Consolidation Department towards grant of seniority in the revenue Department. It has been explained that there was a mistake while fixing his date of seniority vide order (P.10) and therefore, the same was withdrawn vide order (P.12), however, it is reiterated that the benefit of previous service has been granted to him towards seniority.

Learned state counsel points out that in view of the submissions made in the written statement, no further adjudication is required, especially when the LRs of the petitioner have not come forward as the petitioner is stated to have since died on 09.11.2013 after filing of the present petition. Dismissed as infructuous.
