Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.34 dated 27.03.2016 under Sections 37, 411, 420, 467, 468, 471, 201, 120-B IPC and Section 27, 29, 35

(5) of Wild Life Protection Act, 1972, registered at Police Station Khizrabad, District Yamuna Nagar.

Notice of motion was issued. Learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that as per the FIR and also as argued by learned State counsel, the only allegation against the petitioner is of Vineet Gulati 2017.04.21 17:13 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-9025 of 2017 -2connivance with other accused. The present petitioner was not owner of the truck nor he was present on the spot. It is also stated that the truck was already released on sapurdari by the Court and after that, the present FIR has been registered.

The petitioner has already joined the investigation. He is not required for custodial interrogation. Nothing is to be recovered from him. The trial of the case will take long time. No useful purpose will be served by sending the petitioner to custody.

Keeping in view the facts and circumstances of the case and without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case, where the petitioner is entitled to benefit of grant of anticipatory bail. Therefore, the present petition is accepted and the order dated 17.03.2017 granting interim bail to the petitioner is made absolute.
